Right To Be Forgotten
Right to be forgotten informing companies about data subjects when collected requests to remove all the personal data from them. When these are all taken into account, it appears that the EU authorities have been pretty reasonable so far, but this hasn’t always been the case Click here.
The ruling that Google was subject to the country’s regulation on copyright was a fairly good example of how tricky such situations can get. Google said it had no objection to the Irish court’s opinion on Google’s liability under the country’s copyright law.
Search Engine
The only thing it objected to was that Google had to remove links on sites from its search engine, even though Google said it did not have links to the pages removed. Google thought it was much more sensible to ask the court to direct search engines to identify links that were illegal to link to, rather than ask search engines to remove links.
Court Decision
The court rejected Google’s request, however, saying that a court order was not the best way to achieve this. Of course, the case isn’t closed yet, so the impact of the court decision remains to be seen.

Personal Data Concerning
The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the erasure of his or her signature from such data. In that regard, the data subject has the right to the free transfer of his or her personal data by electronic means provided by the controller.
The controller shall provide the data subject with the right to access a data subject’s personal data, to correct, delete, amend, or in any other way restrict the processing of his or her personal data.
Personal Data
The data subject has the right to access personal data collected from him or her and the controller shall be obliged to provide it. Personal data shall include the following information. Any information related to personal data,
The time the personal data was collected. The context of the collection. The categories of data collected. The location of the place from where the personal data was collected and the device used.
Serious Infringement
What the personal data is about and other personal data, information on how the personal data is used, who the data was collected from, and the date the personal data was collected.
Where the personal data was collected, and the name, address, or identification number of the data controller. The data subject shall have the right to correct personal data. A failure to correct any personal data shall be deemed to be a serious infringement.
Controller Permission
The data subject shall have the right to obtain from the controller permission to do so. If the controller denies the permission the data subject shall have the right to file a request to grant new permission. Notification Obligation
The right to be forgotten is reflected a second time in the notification obligation. In addition to erasure, according to Art. 19 of the GDPR, the controller must display a link to the privacy policy in any country of destination.
The difficulty with this is that Internet service providers usually own the server where personal data is stored. That makes it difficult for the company to link back to the original controller. The agreement that comes as a result of the first tranche of the GDPR gives effect to the right to be forgotten from 25 May 2018. Although every country has a similar obligation, the mechanism has also been modified.
Procedure
While erasure from processing is sufficient in itself, the procedure of filing a form, providing evidence of the fact, and requesting the establishment of a beneficiary information scheme, already established in some European countries, is envisaged in this new form.
After this second reading of the law, the European Commission will now prepare a report outlining transitional measures that the Union expects to be adopted by the Council and Parliament this summer.
